1.1 Agreement
By utilizing Top Deck Transportation’s services, the customer (referred to as "Client") agrees to all terms and conditions listed herein.
1.2 Scope of Services
Top Deck Transportation provides specialized logistics and transportation services with a focus on project logistics and open deck transportation. These services are subject to availability and feasibility.
2.1 Rates and Charges
Rates are provided based on the details supplied by the Client, including (but not limited to) cargo specifications, destination, and delivery timelines. Any variations or changes to the shipment may result in additional charges.
2.2 Payment Due Date
Payment for services is due within ten (10) days of invoice issuance unless otherwise agreed upon in writing. Late payments may incur interest charges as permitted by law.
3.1 Cargo Details
It is the Client’s responsibility to provide accurate specifications for cargo, including weight, dimensions, hazardous materials information, and any other relevant details. Any inaccuracies may result in delays, additional fees, or refusal to transport.
3.2 Packaging and Securing Cargo
The Client must ensure that cargo is packaged, labeled, and secured in compliance with all applicable laws, regulations, and industry standards. Top Deck Transportation reserves the right to refuse inadequately prepared cargo.
4.1 Carrier Liability
Top Deck Transportation's liability is limited to the value of the cargo or $2.00 per pound, whichever is lesser, unless otherwise agreed upon in writing before shipment. Liability does not extend to loss or damage resulting from inherent defects, improper packaging, acts of God, or any other unforeseeable events beyond Top Deck’s control.
4.2 Claims and Notice
Claims for damage or loss must be submitted in writing within seven (7) days of cargo delivery, accompanied by sufficient proof of the damage or loss. Failure to provide notice within this timeframe may result in the denial of the claim.
5.1 Cargo Insurance
Top Deck Transportation does not provide automatic cargo insurance. The Client may request cargo insurance at an additional cost, or they are responsible for securing their own coverage if needed.
5.2 Proof of Insurance
Upon request, Top Deck Transportation can provide certificates of insurance regarding its own operational liability, but not covering individual shipments unless otherwise specified.
6.1 Delivery Times
Top Deck Transportation will endeavor to meet all agreed-upon delivery schedules. However, due to the nature of open deck and project logistics, delivery timelines are estimates and may be affected by factors beyond Top Deck’s control.
6.2 Unforeseen Delays
Top Deck Transportation is not liable for delays caused by weather, natural disasters, governmental actions, or any other external factors. Any additional costs incurred due to such delays may be the responsibility of the Client.
7.1 Service Modifications
The Client must provide at least 24-hour notice for any cancellations or changes. Modifications or cancellations within 24 hours of the scheduled pickup or delivery may incur additional fees.
